Do not use one word for both orders
Family statutes are already separated in . Adoption and guardianship need the same caution. Read the candidate Act with the . If a course asks whether a personal law’s limit on adoption sits comfortably with equality guarantees, that argument belongs to and to cases you open. This page will not decide that argument or invent a holding.
Which texts students are sent to, without a universal rule
The Hindu Adoptions and Maintenance Act is a statute about adoption for the people it covers. It is not the adoption law of every community. The Guardians and Wards Act is about guardianship, not a general adoption code. Juvenile justice legislation has been used as a secular route for some adoptions, including cases the personal law does not itself provide. Say that as a pointer. The conditions, the authorities, and the effects are in the current text. This note will not state an age of the child, an age of the adopter, a religion test, or a court fee. Those lines change and they differ by statute. Confirm them on India Code for the year you are studying.
How to answer
Say whether the problem asks for a new legal parent or for an adult to look after the child. If it asks for both, write two paragraphs. If the problem does not identify the parties’ personal law or the statute, say the route depends on that fact. Do not tell a family to sign a private paper and call it an adoption. Informal care is a fact. It is not, by itself, the legal status.
A hypothetical about a private deed
Hypothetical. An uncle drafts a “adoption deed” on plain paper and says the child is now his son for every law in India. A student agrees because the family consented. The rewrite says consent on a private page is not the statutory process, guardianship and adoption have been collapsed, and no age or fee is supplied to make the deed look official. The child is not reassigned by the classroom.
A checklist for these two ideas
Separate the orders. 1. Ask whether the relief is adoption or guardianship. 2. Name the statute or say it is unnamed. 3. Do not apply the Hindu adoptions Act to every family. 4. Treat juvenile justice legislation as its own text. 5. Do not invent ages or fees. 6. Do not treat a private letter as an order. 7. Confirm the Act on India Code.
Kanoons Academy does not currently list a separate LAWCET, CLAT, or AP LAWCET batch in the catalogue; these notes are study material, and counselling is via . The nearest catalogue course is . That course teaches how to read an Act, a rule, and a judgment note. It is not an entrance-test batch, and the button on this page uses the course’s own name.
Frequently asked questions
Is adoption the same as guardianship?
No. Adoption creates a parent-child relationship under the statute that permits it. Guardianship gives an adult duties of care. The orders are different.
Does one Act govern every adoption in India?
No. The Hindu adoptions statute covers the people it covers. Other routes, including child-welfare legislation, have their own conditions. Read the text that applies.
Can a family adopt by a private letter?
A private letter is not the statutory process. Informal care may be real. Legal status follows the Act, not the stationery.
Will you state the age limits?
No. Ages and eligibility are in the statute and can be amended. Look them up. Do not memorise them from a blog.
