Amendment is a power with a limit
Article 368 of the Constitution provides a procedure for amendment. The basic structure doctrine is the judicial principle that this power, wide as it is, does not include the power to destroy the Constitution's basic structure. The case associated with that principle is Kesavananda Bharati v State of Kerala. You should be able to say that sentence without pretending you have memorised the opinions. The opinions are long. The is the usual one: court, issue, reasons that were necessary, order. This note will not invent paragraph numbers. If a guidebook says "paragraph 14 held," open paragraph 14 or do not quote it.
The surrounding subject is . Review as a wider idea is . Fundamental rights are a different Part, mapped in . A right and a limit on amendment can both matter in one problem. They are still different questions. Confirm Article 368's current text on India Code. Amendments about amendment are a place where old copies mislead.
What you may say before you have read the report
You may say: Parliament may amend; the procedure is constitutional; Kesavananda is understood as holding that the basic structure cannot be destroyed by that power. You may say that later cases have treated particular features as basic, and that you will not list them as a closed code. You may not say the Supreme Court published an official inventory in this article. It did not. Illustrations you will meet in class often include the supremacy of the Constitution, the democratic and republican form, secularism, federal character, separation of powers, and judicial review. Treat that sentence as a study hint about what to look for in the cases. Do not treat it as Kesavananda's decree reproduced here. If your memo needs a feature, cite the case that discussed that feature, after you have read it.
Why a fake list is worse than a short principle
A fake exhaustive list makes you apply "basic structure" to a municipal bye-law or a contract. That is a category error. The doctrine is a restraint on constitutional amendment. Ordinary laws fail, when they fail, because they violate a right or another constitutional limit, which you argue in those terms. Using the grandest doctrine for the smallest act is not depth. It is a way to avoid the statute. Read the statute with the when the problem is statutory.
Procedure still matters
Even a permitted amendment must follow the procedure Article 368 states, including any special majority and, where required, ratification. The basic structure point does not excuse you from reading the procedure. A problem may be only about procedure. Answer that problem. Do not flee to the doctrine because the name is famous.
How to write the paragraph in an exam or a note
One clean paragraph beats a page of case names. State the power. State the limit. Name Kesavananda as the case associated with the limit. Stop, unless you have opened a further case and can say what it decided. If the question asks whether a particular amendment is void, and you have not read the challenge, say what the test is and what fact you would need. Inventing the outcome is not doctrine. It is fiction.
Maneka Gandhi belongs to the Article 21 conversation about fair procedure, which the rights note mentions at principle level. Do not drop it into a basic-structure answer because both are famous. Fame is not relevance.
A hypothetical about a bye-law
Hypothetical. A college bye-law changes a dress rule. A student writes that the bye-law violates the basic structure of the Constitution. No constitutional amendment is in the facts. The doctrine has been used as a decorative hammer.
The rewrite asks whether the college is the State for a fundamental-rights claim, which right is engaged, and what the bye-law actually says. Basic structure stays in the notebook for the week the class reads Article 368. The student can still think the bye-law is harsh. Harsh is not the name of the doctrine. Writing the famous name did not identify the act under challenge, so it could not identify the legal test either.
A checklist for using the doctrine
Keep it in its box. 1. Confirm the problem is about a constitutional amendment, not an ordinary act. 2. Read Article 368's procedure as well as the limit. 3. State the Kesavananda principle in one sentence. 4. Add a feature only from a judgment you opened. 5. Do not type a paragraph number you have not seen. 6. Do not call the study hint in this article the court's schedule. 7. Confirm the constitutional text on the official source before you describe the amending power.
If the problem is not an amendment, choose a different doctrine on purpose, not by accident.
No doctrine is a product
Kanoons Academy does not currently list a separate LAWCET, CLAT, or AP LAWCET batch in the catalogue; these notes are study material, and counselling is via . The nearest catalogue course is . That course teaches how to read an Act, a rule, and a judgment note. It will not brief Kesavananda for you. The button uses the course's name.
Learn the limit. Read the case when you cite it.
Frequently asked questions
Does basic structure strike down ordinary statutes?
The doctrine is about the amendment power. An ordinary statute is tested against fundamental rights and other constitutional limits. Do not use the doctrine's name for every challenge.
What is the closed list of basic features?
There is no closed list this note will print as if it were the judgment's schedule. Cases discuss features. You read those cases for what they treated as basic.
Is Kesavananda the only case?
It is the case associated with establishing the principle. Later cases apply and discuss it. Cite a later case only after you open it.
Can I quote a paragraph number from memory?
No. A paragraph number you have not checked is a false citation. Describe the principle and then read the report.
Does the doctrine freeze the Constitution?
It limits destruction of the structure by amendment. It does not, on this note's account, forbid every change. The line is in the cases.
Is this needed for LAWCET?
Only if your year's syllabus actually tests it. Degree study needs the principle. An entrance booklet is a different document.
