Section 10 is the list, and it is short
The essentials of a valid contract are the conditions section 10 of the Indian Contract Act uses to decide that an agreement is a contract. Read it as a definition section, not as a moral essay. The agreement must be made by the free consent of parties who are competent to contract, for a lawful consideration and a lawful object, and it must not be one the Act expressly declares void. The same section says it does not wipe out other laws that require writing, witnesses, or registration. The wider introduction is . If you only remember a five-word chant and drop "free" from consent, you have dropped the section's point.
This page explains the ideas. It does not cite a pile of section numbers it has not asked you to open. Where a later section defines a word, open that section when your problem needs the definition. Confirm the text on India Code. A card printed for an entrance test is not the Act.
Each essential is a question about the facts
Offer and acceptance are how you find the agreement itself. If you cannot point to who offered what, and who accepted, you do not yet have parties bound to a bargain. Consideration asks what was given for the promise. A bare promise of a gift, in the usual student problem, is where this question gets sharp. Capacity asks whether the person could contract. Free consent asks whether agreement was produced by a flaw the Act treats as destroying freedom, not merely by a bad bargain. Lawful object and lawful consideration ask whether what is promised, and what is paid for it, can be the subject of a contract. The last phrase of section 10 sends you to agreements the Act itself calls void. You still look them up. You do not invent the category.
Consent is not a vibe
A person can agree and still not give free consent if the Act's defect is present. Pressure, deceit, and a relationship the Act treats as capable of undue influence are legal ideas with elements. A hard bargain, without more, is not automatically coercion. Write the element, then the fact that matches it. If the fact is missing, the element is not proved by adjectives. here means opening the definition, not collecting synonyms.
Other laws sit beside the list
Writing and registration are not "extra essentials" you add because a template has a signature block. They apply when the law of that transaction says so. Section 10 tells you not to ignore them. A sale of land and a promise to lend a book do not travel together. Property's transaction types are a different note. For class drafting, tells you not to sign the exercise. Do not "cure" a missing essential by typing a clause that pretends the fact existed.
Formation before breach
If an essential fails, talk about formation. is the vocabulary for a contract that was born and then broken. Students who start with damages skip the list and invent a lawsuit. Also resist specific performance as a reflex. It is a remedy with its own statute and its own discretion. It is not essential number eight.
Competence and consent problems are sensitive because they involve real people. In a problem question, stick to the given facts. In life, do not accuse someone of fraud in a letter because this note named fraud as a concept. That warning is the notice note's warning too. Concepts are for analysis. Allegations are for instructed counsel.
A hypothetical about a chant
Hypothetical. A student writes "offer, acceptance, consideration, done." The problem says the signer was a minor, and the object was an agreement the Act would not enforce. The chant is neat and fails section 10 twice. Capacity and lawful object were on the list the chant shortened.
The repair writes each essential and marks "not shown," "shown," or "problem says the party is a minor." It cites section 10 as the definition section after opening it, and it does not invent a second section number for minors unless the student has read that section and can say what it does. Honesty about an unread section is part of the answer.
A checklist against the definition
Use the section as the checklist. 1. Find the agreement. 2. Ask whether consent was free, and name a defect only with facts. 3. Ask whether each party was competent. 4. Identify consideration and ask if it is lawful. 5. Identify the object and ask if it is lawful. 6. Ask whether the Act expressly voids this kind of agreement. 7. Ask whether some other law demands a form, and confirm every citation on the official text.
If you cannot tick a line, the line is your next paragraph. Do not skip to a remedy paragraph to hide the gap. A remedy paragraph that assumes a contract the earlier lines have not found is how marks are lost and how real disputes are misdescribed.
The Act remains the source
Kanoons Academy does not currently list a separate LAWCET, CLAT, or AP LAWCET batch in the catalogue; these notes are study material, and counselling is via . The nearest catalogue course is . That course teaches how to read an Act, a rule, and a judgment note. The button uses the course's name. It will not certify your agreement.
Section 10 is the list. Read it whenever the chant gets shorter than the law.
Frequently asked questions
Is consideration always money?
No. Consideration is what the law treats as given for the promise. Money is a common example, not the definition. Read the Act's definition rather than a shop example.
What is free consent?
Consent is free when it is not caused by the flaws the Act names, such as coercion, fraud, misrepresentation, or undue influence, in the sections that define them. Name a flaw only if the facts support it.
Who is competent?
Competence is the Act's idea of who may contract, including age and soundness of mind as the Act states them. Do not invent an age if you have not read the section.
What does 'expressly declared void' add?
It points you to agreements the Act itself condemns. You still have to find the provision. Do not assume every unfair bargain is expressly void.
If one essential fails, is there a breach?
Usually you are not yet in breach analysis. You are in formation. The breach note assumes a contract to break.
Can a draft skip an essential to look short?
A class draft that skips consideration or consent is incomplete. A real draft that hides them is dangerous. Label class work as class work.
