Proof is a discipline, not a pile of papers
Evidence law basics tell a court, and therefore a student, which facts may be used and how sure the decision-maker must be. The statute now in force is the Bharatiya Sakshya Adhiniyam. The Indian Evidence Act is the historical name. You will see the old name in older judgments and textbooks. Treat it as a historical label. Do not build a conversion chart of section numbers. If a course still teaches from the old numbering because the paper says so, follow the paper and still check what is in force on India Code. The substantive criminal ideas are in . This page is about proof.
A document in a file is not yet evidence in the legal sense. It becomes usable when the Act's conditions for that kind of material are met: relevance, and the rules on documents, witnesses, and exclusions. means reading the exclusion as carefully as the permission.
Three concepts that organise the course
Relevance asks whether the fact helps to prove what is in issue, as the Act frames relevance, not whether the fact is interesting. Burden of proof asks who must establish a fact and to what standard. In a criminal trial the prosecution's burden is not the same idea as a civil claimant's burden. Say which proceeding you are in. Proof is the result of applying those rules to the material, not a feeling that the story is obvious. Standard of proof is part of that result. Do not write "beyond reasonable doubt" into a civil problem, or a balance of probabilities into a criminal one, unless you have checked that you are in that kind of case.
What you should not memorise from a list
Dying declarations, confessions to police, expert opinion, and electronic records are topics courses reach one by one. Each has conditions. A list of section numbers in a social-media image is how students cite the wrong exclusion. When you need one of these topics, open the Act and write the condition in your own words. is that opening. A judgment that applied the rule is read with the , and the judgment does not replace the section.
Presumptions are not magic
Some provisions tell the court to presume a fact until it is displaced. A presumption is a rule about who must go next. It is not proof that never needs looking at. Write what is presumed and what would displace it. If you cannot, you are using the word presumption as a decoration. Electronic records frighten students into either rejecting all of them or accepting a screenshot as a judgment. The Act has a method. Follow the method in the text you have opened. Do not follow a vendor's slogan about a file format.
Civil, criminal, and the same statute
The evidence statute is not only a criminal handbook. Civil trials use it too, with the burden appropriate to civil claims. A tort problem about may later become a proof problem. Do not import criminal standard of proof into a negligence element list. Also do not treat the evidence Act as the offence. The offence says what must be true. Evidence says how you show it. Mixing them produces answers that convict on a definition and never ask who proved the fact.
Old cases will cite the Indian Evidence Act. Read them for the principle and then locate the current provision if you need to cite a number. If you cannot locate it, cite the case's principle and say the current section number is unchecked. An unchecked number is not a small risk. It is a false pinpoint.
A hypothetical about a screenshot
Hypothetical. A student is given a screenshot of a chat and told to "prove the crime." The student writes a section number from a forwarded image and says the screenshot is conclusive. The number was for a different idea. The screenshot has no witness, no certificate discussion, and no link to the offence's elements.
The rewrite says: identify the fact the chat is offered to prove; ask whether the Act treats this electronic material as receivable and on what conditions; say the problem has not given those conditions; refuse a section number that was not opened. The crime's definition stays in the criminal-law paragraph. The screenshot stays a piece of material, not a verdict.
A checklist for an evidence paragraph
Separate the jobs. 1. State whether the proceeding is civil or criminal. 2. State the fact to be proved. 3. Ask whether it is relevant in the Act's sense. 4. Ask who bears the burden. 5. Ask which exclusion might apply, and open it. 6. Do not convert an old section number by guesswork. 7. Confirm the text on India Code or the prescribed bare Act before you cite a number.
If the problem gives no material, your answer is that proof has not been discussed, not that the party with the louder story wins.
Proof, not a script
Kanoons Academy does not currently list a separate LAWCET, CLAT, or AP LAWCET batch in the catalogue; these notes are study material, and counselling is via . The nearest catalogue course is . That course teaches how to read an Act, a rule, and a judgment note. It will not prove a case. The button uses the course's name.
Learn relevance, burden, and proof. Leave the section number in the Act until you have seen it.
Frequently asked questions
Is the Indian Evidence Act still the name to buy?
Buy or open the text your syllabus and the law in force require. The current name is the Bharatiya Sakshya Adhiniyam. Old copies use the old name. Do not assume the numbers survived unchanged.
What is relevance?
Relevance is the idea that a fact is allowed into the reasoning because it bears on what must be decided, in the way the Act defines. Not every true fact is relevant to this case.
Who has the burden of proof?
The Act allocates burdens. A civil claimant and a prosecutor do not carry the same burden in the same way. Read the provision and the kind of case. Do not memorise one sentence for every forum.
Is a confession always usable?
No. Admissions and confessions have conditions and exclusions in the statute. A dramatic statement is not automatically proof. Open the text.
Does evidence law decide guilt by itself?
It governs how facts are established. The offence definition is criminal law. The judgment's reasons are a different text. Keep the three distinct.
Will you list the sections on dying declarations?
No. That would be a section dump and a risk of a wrong number. Find the provision in the Act you are using.
