Match the statute to the parties
Family law basics in India are a set of statutes, not a single mood about fairness. Who the parties are, and which Act they married under, decides which text you open. A Hindu marriage solemnised under the Hindu Marriage Act, 1955 is not automatically the same legal object as a marriage under the Special Marriage Act, 1954. Christian marriages that fall under the Indian Divorce Act, 1869 are another text. Parsi marriages are dealt with in the Parsi Marriage and Divorce Act, 1936. Muslim personal law is not one divorce code, and it is not safe to summarise it as a single ground. Parliament has also passed statutes on particular practices. You read the one that applies. You do not announce a ground because a relative's case used it.
This note will not print a list of divorce grounds, a waiting period, a court fee, or a city where you should file. Those are time-sensitive and fact-sensitive. Confirm them in the statute and, if you need a filing, with someone who is allowed to advise. may sit in the background when a personal law is challenged. It does not replace the personal law in a problem about two spouses.
What a first course is actually testing
A first course usually tests whether you identified the right statute and whether you separated marriage, divorce, maintenance, guardianship, and succession. Those are different questions. A student who writes one paragraph called family problems has not started. Maintenance can exist in more than one statute. Guardianship of a child is not a footnote to a divorce ground. Succession tells you who takes property when someone dies. It is not the same as a , although the two can appear in one family's papers.
Do not universalise a ground
If a textbook lists cruelty, desertion, or conversion, it is listing them for a named Act. Write the Act's name in the same sentence. If you cannot, you are exporting one community's rule. The exam error and the human error are the same. The Special Marriage Act has its own structure. Do not correct it with a ground copied from the Hindu Marriage Act. Do not correct the Hindu Marriage Act with a practice you heard described as Muslim law.
Instant formulas are not the law
Slogans about instant divorce, about a fixed number of pronouncements, or about one gender always keeping the children are not authorities. Some practices have been changed by statute. The safe classroom sentence is that you will read the Act that governs these parties, including any later statute that restricts a practice, on India Code. is the method. A coaching chart of grounds is not the method. A contract between spouses, where one exists, is still not a substitute for the status rules. may explain a separate agreement. It does not dissolve a marriage.
How to write an answer without advising
State the facts you were given: the ceremony or the Act named in the problem, the relief asked for, and who is asking. Name the candidate statute and say what you still need to confirm. If the problem does not say which Act applies, your first sentence is that the answer depends on that fact. Do not fill the gap with the Act you revised last week. Do not tell the reader to send a notice, to leave the house, or to file tomorrow. Sending a paper into a family dispute can change rights. This page is a study note.
Hypotheticals in class are allowed. They are labelled as hypotheticals. They are not your cousin's instructions.
A hypothetical about a borrowed ground
Hypothetical. A student is asked about a marriage under the Special Marriage Act. The student writes the grounds they memorised from the Hindu Marriage Act, with the same section numbers, and adds that the result is identical because both are Indian.
The rewrite says the problem named a different Act. The grounds and the procedure have to be read in that Act. Section numbers from another statute are not borrowed. The answer stops at the method: open the Special Marriage Act, identify the relief, and refuse a ground that was not checked. Nobody is told which parent should have the child. The problem did not ask for a custody order, and this note would not give one.
A checklist for a family-law problem
Keep the statutes apart. 1. Write which Act the problem names, or write that it does not name one. 2. Separate marriage, divorce, maintenance, guardianship, and succession. 3. Never state a ground as the Indian ground. 4. Do not copy a Muslim-law slogan into a Hindu Marriage Act problem, or the reverse. 5. Treat a later statute that restricts a practice as something you must open, not as a headline. 6. Keep living transfers in the property chapter. 7. Do not name a court, a fee, or a waiting period from memory.
If you cannot point to the section you are using, describe the principle and say the pinpoint is unchecked.
A map, not a petition
Kanoons Academy does not currently list a separate LAWCET, CLAT, or AP LAWCET batch in the catalogue; these notes are study material, and counselling is via . The nearest catalogue course is . That course teaches how to read an Act, a rule, and a judgment note. It will not file a family petition. The button uses the course's name.
Read the statute that applies to these parties. Leave every other community's ground in its own Act.
Frequently asked questions
Is cruelty a ground for everyone in India?
No. Cruelty appears in some statutes. It is not a universal ground you can paste onto every community and every marriage. Open the Act that governs those parties.
What is the Special Marriage Act for?
It is a civil marriage statute. People use it when they marry under that Act rather than only under a personal law. The conditions and the remedies are in that Act. Read them.
Is Muslim divorce one procedure?
No. Muslim personal law is not one divorce code, and Parliament has also legislated on specific practices. Read the text that applies. Do not repeat a slogan about instant divorce.
Does this page tell me which court to file in?
No. Jurisdiction, limitation, and procedure depend on the statute and the facts. A classroom note that names a court for you would be pretending to advise.
Are succession and divorce the same subject?
They meet in family life and they are different chapters. Inheritance can also involve the Transfer of Property Act and personal law. Keep the questions separate.
Can I use a friend's decree as my template?
No. A decree is a court's order in someone else's facts. Copying it is not research and it can be misused as if it were advice.
