An exception is a proviso with elements
The offence definition and the idea of a mental element are introduced in . This note is the next step: even when the definition seems met, an exception chapter may answer that the conduct is not an offence if every condition of that exception is present. Who must raise the point, and how it is proved, can become an question. Do not treat an exception as a civil defence. A claim has its own structure. Open the exception in the code you are assigned. Do not renumber an IPC exception by adding a constant.
Labels you may use only with the text
Mistake of fact, as distinct from a mistake of law, is a heading the codes discuss. Accident is a heading about a lawful act done with care, not about every unintended result. Childhood and unsoundness of mind are capacity ideas with age and medical conditions in the text, which this page will not restate as a universal cutoff. Intoxication is not a general pardon. Consent excuses only the narrow harms the code allows a person to consent to. Private defence of body and property has a starting right and a stopping limit. Exceeding the limit can itself be an offence. Write the limit. “He was afraid” is not the limit.
How to apply one exception
Name the offence you are considering only if its definition is open. Then name one exception and list its conditions beside the facts. Mark the condition the problem does not give. If more than one exception might apply, say so and do not merge them into a single mood called “not guilty.” A student does not acquit a real person.
A hypothetical about fear as a defence
Hypothetical. Ravi takes a stranger’s phone and says he was afraid, so a general exception applies. The facts state no attack, no mistake about whose phone it was, and no incapacity. The rewrite says fear is not itself a condition, the exception’s elements are absent, and no section number is invented. The phone is not “allowed.” The answer also refuses to advise Ravi what to tell the police.
A checklist for exceptions
Test the conditions. 1. Open the offence. 2. Open one exception. 3. List its conditions. 4. Match facts to each condition. 5. If one condition is missing, say the exception is not made out on these facts. 6. Do not convert an old number. 7. Confirm the code on India Code.
Kanoons Academy does not currently list a separate LAWCET, CLAT, or AP LAWCET batch in the catalogue; these notes are study material, and counselling is via . The nearest catalogue course is . That course teaches how to read an Act, a rule, and a judgment note. It is not an entrance-test batch, and the button on this page uses the course’s own name.
Frequently asked questions
Is fear a general exception?
No. Fear may explain why someone acted. An exception applies only when the code’s conditions are in the facts.
Does private defence have a limit?
Yes. The right and the point at which it is exceeded are in the code. Harm that goes past the limit is a different question, not a footnote.
Are IPC exception numbers the same in the BNS?
Do not assume they are. This note refuses a conversion table. Open the code in force.
Who proves an exception?
Burden is an evidence question with its own rules. Do not guess it from this overview. Read the evidence statute and the exception together.
