When the file is an ITR-3 file
Use ITR-3 when the person earns business or professional income that must be computed from books, or when a presumptive scheme is unavailable, declined, or disqualified by other income. Partners in a firm generally land here because remuneration and interest from the firm, and sometimes the share of profit, are reported on this form rather than on a salary-only form. Confirm the partner schedule against this year's instruction.
Hindu undivided families with a business use the same form. Companies do not. If you are unsure whether a presumptive scheme would legally shrink the work, read and the scheme conditions before you build a full manufacturing-and-trading account. The selection path is .
Books first, return second
The profit the return carries is the profit the books show after the Act's adjustments, not a percentage you hope is acceptable. Start from a trial balance: sales, other income, purchases, direct expenses, and indirect expenses, with personal expenses removed. Depreciation follows the rates and blocks the income-tax rules use, which differ from the Companies Act rates a company accountant may have applied. This guide does not print depreciation percentages. Use the official table for the year.
A balance sheet is part of the story when the form asks for it: capital, loans, fixed assets, debtors, stock, and cash. Stock should tie to a count, debtors to a list, and cash to a book that does not go implausibly negative. are the habit that makes this schedule possible. A GST return total is a cross-check on turnover, not a substitute for the profit-and-loss account. explains why those returns exist; they are not this form.
Adjustments the Act still requires
Expenses the Act disallows, income taxed under another head, and incentives or exemptions that belong in a specific schedule are adjusted off the accounting profit. Write each adjustment as its own line with a reason, not as a plug to reach a round profit. If you cannot name the reason, the adjustment does not belong. The form's reconciliation from profit as per books to income under the head is the page a reviewer reads first.
Audit, when the law asks for it
Some businesses must have their accounts audited under the income-tax law, and some professionals must, based on turnover or gross-receipts tests the Finance Act sets. Those tests change. If an audit applies, the return is not ready until the audit report is filed in the way the portal requires and the numbers match. Read the current test on https://www.incometax.gov.in/. This guide does not state a turnover trigger. If you are near a line you remember from an older year, re-read the line.
Other heads still sit on the same return
A proprietor can have salary from somewhere else, a house, capital gains, and interest. ITR-3 has schedules for them. The business schedule does not absorb a share sale. Classify the gain on its own schedule under the year's rules, the same way would, and keep special-rate tax off the slab base. Regime choice for a person with business income can restrict a later switch. Read that condition before opting out of the default regime.
Tax deducted by clients on professional fees is a credit, matched to certificates and the tax-credit statement. It is not a reduction of gross receipts. Advance tax, if the law required it for this income, is also a credit. The computation sheet should show business income, other heads, tax, and credits in that order. Filing mechanics after the sheet agrees are in .
A designer who kept books and sold a mutual fund
A resident consultant raised invoices all year, paid a part-time assistant, bought a laptop, and redeemed a mutual fund in February. Turnover may or may not sit inside a presumptive ceiling; the fund sale may or may not be allowed inside the presumptive form this year. Assume, for this file, that the utility has already refused ITR-4 because of the gain. ITR-3 is the form. The books show receipts, the assistant's pay, software, and depreciation on the laptop under the income-tax table. The mutual-fund statement feeds the capital-gains schedule with dates and cost.
Clients deducted tax on some invoices. Those credits go to the tax-paid schedule, and the gross invoice stays in receipts. Personal drawings are not an expense. At the end, the computation shows professional income at slab or regime rates and the mutual-fund gain on the special-rate line the year requires. If the audit test is met, the audit report is filed before anyone treats the return as ready.
Checklist for an ITR-3 file
Do these in order. 1. Confirm the person is an individual or a Hindu undivided family with business or professional income. 2. Decide, from this year's portal text, that a presumptive form is not available or not chosen. 3. Close the books: trial balance, bank reconciliation, stock, and debtors. 4. Compute depreciation from the income-tax table for the year. 5. List Act adjustments with reasons. 6. Test the audit trigger on the official page and complete the report if it applies. 7. Place every non-business head on its own schedule. 8. Read the computation, submit, and verify.
A reviewer should be able to walk from the acknowledgement to the trial balance without asking for a missing workbook. drills that walk on a sample proprietorship before students touch a live PAN.
What ITR-3 is not
It is not the company return, and it is not a GST annual return pasted into a business schedule. It is not a place to hide personal expenses inside purchases. It is not the presumptive shortcut: if you are eligible for that scheme and the other facts allow ITR-4, building a full ITR-3 is a choice, and you should know you are making it.
Numbers you cannot trace to an invoice, a bank line, or a statutory table come out of the file. The portal will still accept a typed profit. The notice later will ask for the ledger. Build the ledger first.
Frequently asked questions
Can a partner of a firm use ITR-1?
Partnership income is a business-head fact. Partners ordinarily use ITR-3. Confirm the partner schedule on this year's utility.
Is GST turnover my business income?
Turnover is a starting figure. Income is turnover minus allowable expenses, after the Act's adjustments. A GST return is a cross-check, not the profit line.
What turnover forces a tax audit?
The Act and the Finance Act set the test, and it changes. Read the current threshold on https://www.incometax.gov.in/. This guide does not print it.
Can I use presumptive taxation inside ITR-3?
If you are eligible and the form that matches the scheme is ITR-4, that is the usual return. ITR-3 is for cases the presumptive form does not cover, or where you compute from books.
Where do I put a share sale on a business return?
On the capital-gains schedule of ITR-3, under the year's classification rules. Do not net it inside the profit-and-loss account and forget the schedule.
Do companies file ITR-3?
No. ITR-3 is for individuals and Hindu undivided families. A company uses the company form the utility offers for that assessment year.
