A check on power, named carefully
Judicial review India students meet in constitutional law is the practice of courts examining whether a law or a public act is within the Constitution. You also meet the phrase in administrative law, where a court examines whether a decision-maker stayed inside the statute that gave the power. The two uses are cousins. They are not the same class. This note keeps them apart and stays at principle level. The subject frame is . The rights often invoked are in . The limit on constitutional amendment is the note. None of those pages is a petition.
The Constitution provides remedies. Article 32 is the Supreme Court remedy for fundamental rights. High Courts have writ jurisdiction that you should read in the Article your syllabus assigns, rather than from a coaching expansion. Confirm the current text on India Code. This article will not invent a new writ or a new ground.
What review is, and what it is not
Review asks a legal question: was this act permitted by the Constitution or by the statute that conferred the power? It is not, as a definition, a second political vote. Courts give reasons and make orders. Those orders bind the parties and, in constitutional cases, shape what other authorities may do. The shape is in the judgment. If you have not read the order, you do not know the shape. Use the . A headline that a court "banned" a policy is not the order.
Grounds you may name only after you read them
Students collect words: ultra vires, procedural fairness, proportionality, arbitrariness. Each word has a body of cases. Using the word without the case is decoration. In a problem, start with the text that gives the power, then the fact said to exceed it. The habit applies to the statute under which the officer acted. If the statute is not in the problem, say so. Do not supply a ground because it sounds modern.
Rights review is not every grievance
A writ alleging a fundamental right still needs a right, a State actor where the Article requires one, and facts. Private unkindness is not automatically a constitutional case. Article 12 is the starting definition for that question, and it is explained as a map in the rights note. Do not file, even on paper in a careless way, a constitutional case that is really a contract dispute. Contract has its own subject. Mislabeling the forum is not advocacy. It is a category error.
Amendment review is a special question
When the challenge is to a constitutional amendment, you are in the territory of amendment procedure and the basic structure doctrine. That is not the same as challenging an ordinary tax notification or a university order. Say which kind of act is in front of you. Kesavananda Bharati is the name associated with the basic-structure principle. It is discussed in the basic-structure note at that level of care. Do not cite it as a general spell that voids any law you dislike.
Also refuse to predict. A note can say what question a court would ask. It cannot say how an unheard petition ends. Prediction in a student essay is often a disguised advice. This page does not advise.
A hypothetical about the wrong label
Hypothetical. A municipal officer refuses a trade licence. A student writes "judicial review means the Supreme Court will strike this down under the basic structure." The act in the problem is an officer's decision under a municipal law, not a constitutional amendment. The label is grand and misplaced.
A better note says: identify the statute that gives the officer the power, ask whether the refusal stayed inside that power and any required procedure, and only then ask whether a constitutional right is even engaged. It names no result. It names the questions. That is review as a method. The result waits on a record this hypothetical does not contain.
A checklist before you use the phrase
Earn the phrase. 1. Say whether you mean review of a law, of an amendment, or of an administrative decision. 2. Name the text that is said to be exceeded. 3. Name the court only if the problem or the case puts you there. 4. Separate Article 32 from High Court writ jurisdiction by reading both. 5. Open any case you name and record its order. 6. Do not call policy disagreement a ground. 7. Confirm the Articles on the official text, and do not invent a test the judgment does not contain.
If you cannot do step 1, you are not ready to write the essay. You are ready to sort the problem.
Reading, not a writ clinic
Kanoons Academy does not currently list a separate LAWCET, CLAT, or AP LAWCET batch in the catalogue; these notes are study material, and counselling is via . There is no judicial-review clinic in the catalogue. The nearest course is . That course teaches how to read an Act, a rule, and a judgment note. The button on this page uses the course's name. It will not draft a petition.
Ask the legal question the doctrine actually asks. Leave the result to the court that has the record.
Frequently asked questions
Is judicial review written in one Article?
Several Articles matter, including those on fundamental rights, constitutional remedies, and High Court writs. Do not collapse them into one homemade Article number.
Can courts rewrite a statute they dislike?
Review is a legal check against constitutional or statutory limits. It is not a power, stated here, to replace a policy you happen to dislike. Read the judgment for what the court actually did.
Is every government decision reviewable on the merits?
No. Some review looks at legality, procedure, and the limits of the power. A full appeal on the merits is a different idea. Your syllabus's cases show which is which.
What is a writ?
A writ is a constitutional remedy in the form the Articles and the court's practice describe. Naming certiorari or mandamus without the facts is not analysis.
Does basic structure replace judicial review?
Basic structure is a doctrine about amendment. Judicial review is part of how constitutional limits are enforced. Read both notes and then the cases.
Will this predict a petition's result?
No. Prediction would be advice on facts this page does not have.
