Work sits in more than one document
A letter that hires someone is often a contract, so still matters. Statutes then add rights the contract cannot simply delete. The constitutional conversation about equality, forced labour, and the freedom to associate sits in when the problem is actually constitutional. For everything else, that the problem names. India has had factories legislation, industrial-disputes legislation, wage legislation, and social-security legislation, and legislatures have also passed labour codes whose commencement is a fact you must check. This page will not declare a code “in force everywhere.”
How to practise the subject
Write the workplace and the statute the problem names. If it names none, say the answer depends on which Act applies and on facts such as the nature of the work. Do not invent a compensation month-multiple. Do not advise a strike or a lockout. Those are regulated acts with consequences. A student note is not a union circular.
A hypothetical about a remembered wage
Hypothetical. A problem says a helper is paid in cash at a small workshop. The student writes a daily wage taken from a coaching chart and says the new labour code has replaced every older Act in every State. The rewrite deletes the wage, refuses the nationwide commencement claim, and lists the facts still needed: the work, the place, and the statute the class was told to open.
A checklist for a labour problem
Split the questions. 1. Ask employee or contractor. 2. Ask which statute is named. 3. Keep wages, termination, and collective disputes apart. 4. Do not state a minimum rate. 5. Do not state a headcount threshold. 6. Do not declare a code in force without the official text. 7. Confirm on India Code or the gazette you were assigned.
Kanoons Academy does not currently list a separate LAWCET, CLAT, or AP LAWCET batch in the catalogue; these notes are study material, and counselling is via . The nearest catalogue course is . That course teaches how to read an Act, a rule, and a judgment note. It is not an entrance-test batch, and the button on this page uses the course’s own name.
Frequently asked questions
Is a labour code in force instead of the older Acts?
Commencement is a legal fact that can differ by code and by notification. This note does not declare a national switch. Check the official text for the workplace you are studying.
What is the current minimum wage?
It is not in this note. Minimum wages depend on the law and the scheduled employment. Look up the figure from the official source for that place and year.
Is every gig worker an employee?
The label does not decide it. Status depends on the statute’s definition and the facts. Do not answer from an app’s marketing.
Does this page organise a dispute?
No. It is a classroom map. A real dispute needs the statute and, where people act collectively, a care this note is not giving.
