Status first, then the statute that created it
The warning that belongs at the front is already the point of : personal laws differ, and a civil marriage Act is another text. This page stays on two concepts, marriage and divorce, and refuses to export a ground from one community to another. Read whichever Act the problem names with the . A constitutional challenge to a personal law, if your course reaches one, is argued from and from the judgment, not from a proverb about fairness.
What “ground” is allowed to mean
A ground is a condition in a named Act. If you write cruelty, desertion, or conversion, you write the Act in the same sentence. If you cannot, you are stating a ground as universal, which this note forbids. Muslim personal law is not one divorce code, and slogans about instant divorce are not authorities. Parliament has also legislated on particular practices. Open that legislation on India Code rather than repeating a headline. A marriage under the Special Marriage Act is not corrected by copying grounds from a different Act. Divorce is also not the only relief a spouse might ask for. Do not treat every marital problem as a petition to dissolve the marriage.
How to answer a classroom problem
State the ceremony or the Act the problem names. If it names none, your first sentence is that the answer depends on that fact. Separate a valid marriage from a void or voidable ceremony only in the words of the Act you opened. Do not tell a person to leave the house, to send a notice, or to pronounce a formula. Class facts are not instructions.
A hypothetical about a borrowed ground
Hypothetical. The problem says the parties married under the Special Marriage Act. The student copies grounds memorised from a different religion’s statute and says the result is identical because both people are Indian. The rewrite names the Act in the problem, refuses the borrowed grounds, and stops. No waiting period and no city of filing are added.
A checklist that refuses a universal ground
Match the text. 1. Write the Act, or write that the problem omits it. 2. Treat marriage as status under that Act. 3. Treat divorce as a ground in that Act. 4. Do not copy a ground across communities. 5. Do not use a slogan about instant divorce. 6. Keep maintenance and children for their own notes if the problem asks. 7. Confirm the Act on India Code.
Kanoons Academy does not currently list a separate LAWCET, CLAT, or AP LAWCET batch in the catalogue; these notes are study material, and counselling is via . The nearest catalogue course is . That course teaches how to read an Act, a rule, and a judgment note. It is not an entrance-test batch, and the button on this page uses the course’s own name.
Frequently asked questions
Is cruelty a ground for every marriage in India?
No. It appears in some statutes. It is not a universal ground. Open the Act that applies to those parties.
What is the Special Marriage Act doing in this subject?
It is a civil marriage statute with its own conditions and remedies. It is not a summary of every personal law.
Can this page tell me whether to file for divorce?
No. Filing is a personal and legal step. This note only shows how to identify the statute.
Are customary practices a ground by themselves?
A practice is not self-proving. Some practices are restricted by statute. Read the text that governs these parties.
