Name the transaction before the clause
Property law basics in a first course are largely the Transfer of Property Act's vocabulary of transfers. Five names do most of the early work. A sale is a transfer of ownership in exchange for a price paid or promised. A mortgage is a transfer of an interest as security for a loan or other engagement. A lease is a transfer of a right to enjoy the property for a certain time, in the Act's terms, usually for a premium or rent. A gift is a transfer without consideration, made voluntarily. An exchange is a transfer of ownership for ownership of another thing, not for money as the price. If you can say which of these a document is trying to be, you can look up the right part of the Act. If you cannot, a section number will not save you. This note deliberately does not print those section numbers. Open the Act with the .
Contract ideas still sit underneath, because many transfers begin as agreements. and the are the prior questions when formation is in doubt. Property law asks what interest, if any, moved.
How the types get confused
People call a long possession a sale. People call a loan with the papers kept by the lender a sale. People call a family arrangement a gift. The label on the first page is evidence of intention. It is not conclusive if the operative clauses do something else. Read the operative clauses. A mortgage that is dressed as a sale is a classic teaching problem. Your job is to describe what interest passed and what money was for, not to recite the cover. Registration and stamp are separate statutes. They matter. Their fees and their lists of compulsory documents change and are not reprinted here. Confirm them on the official text for the State and the year. A note that prints a stamp percentage will be wrong next year and dangerous this year.
Lease is not a junior sale
A lessee gets enjoyment for a term, on the conditions of the lease. A buyer gets ownership if a sale is complete. Mixing the words "landlord sold the flat" when the document is a leave and licence or a lease will wreck the remedy. Eviction, rent, and renewal are lease questions. Title is a sale or a gift or an inheritance question. Ask which box you are in before you ask who wins.
Gifts and family property
A gift in the Transfer of Property Act sense is not every generous impulse, and it is not the whole of family property. Succession and personal laws decide many family disputes. Those rules differ by community and are introduced, carefully, in . Do not use one religion's inheritance rule as the Indian rule. Do not draft a gift deed from this page. here means seeing the parts of a document, not issuing one. A signed deed can transfer rights. A class note must say it is a class note.
What an answer looks like
State the type you think the facts show, and why: price or no price, security or enjoyment, time-limited or ownership. Mention writing or registration only as a question to check in the relevant Act, not as a fee. Do not declare title. Title depends on the chain of documents you do not have in a two-line problem. If the problem is only about an agreement to sell, say you are not yet at the completed transfer. That distinction is one of the most useful in the course.
Constitutional property protections, where your public-law course still discusses them, are a different chapter from the Transfer of Property Act. A taking by the State is not a private sale. Keep the subjects apart even though both use the word property.
A hypothetical about a labelled sale
Hypothetical. A document is titled sale deed. The text says the "buyer" may possess the house for three years on a monthly sum, and the "seller" keeps the right to take it back. A student enforces it as a sale because of the title.
The rewrite says the label says sale, the operative words look like a time-limited enjoyment for a recurring sum, and the right retained by the owner does not look like a completed transfer of ownership. The answer refuses a section number it has not opened and refuses a stamp figure. It tells the class to read the lease provisions and the sale provisions and see which elements match. Nobody is told to register the PDF in the morning.
A checklist for a transfer problem
Sort the type. 1. Ask whether ownership, security, or time-limited enjoyment is what moved. 2. Ask whether the price is money, another property, or absent. 3. If absent and voluntary, consider gift only against the Act's elements. 4. Separate an agreement to transfer from the transfer. 5. Flag registration and stamp as questions for their statutes, without inventing fees. 6. Do not apply one personal law's inheritance rule. 7. Open the Act before you cite a number, and do not issue a deed.
The title of the document is step zero, not step seven.
Types, not a conveyancing shop
Kanoons Academy does not currently list a separate LAWCET, CLAT, or AP LAWCET batch in the catalogue; these notes are study material, and counselling is via . The nearest catalogue course is . That course teaches how to read an Act, a rule, and a judgment note. It will not stamp your deed. The button uses the course's name.
Name the transaction. Then read the part of the Act that defines it.
Frequently asked questions
Is a sale the same as an agreement to sell?
No. An agreement looks forward. A sale, in the Act's scheme, is the transfer itself when the statute's elements are met. Do not use the words as synonyms.
What is a mortgage?
It is a transfer of an interest in property as security for a debt or other obligation. It is not a sale, and it is not a polite word for any loan.
What is a lease?
It is a transfer of a right to enjoy property for a time, or in perpetuity in the cases the Act allows, for a consideration. It is not ownership by another name.
Do all gifts need a registered deed?
Registration and writing depend on the kind of property and the statute, including the registration law. This note will not print a universal rule or a fee.
Is stamp duty part of the definition?
Stamp is a tax regime on instruments. It can affect enforceability in the way that law states. It is not the definition of sale. Look up the current duty. Do not copy one from a blog.
Can I draft my family's partition here?
No. Family property can also involve personal law. This is a classroom map of transaction types, not a deed.
