Death is the line that separates this subject
A transfer while a person is alive, such as a sale or a gift, is . Succession starts because someone has died. Which personal law might apply is the caution in . Read the candidate Act with the . The Indian Succession Act is one statute students meet. It is not the only inheritance law in India. Hindu succession is a different Act. Muslim inheritance is not a single section you can paste. Do not state any of them as the Indian share.
Will, intestacy, and what a will is not
A will is a declaration of how property should pass on death, in the form the governing law requires. A casual message may or may not be a will. Formalities differ. This note will not say every will needs two witnesses or that none does. Open the Act. Intestacy is the residual scheme when no valid will covers the property. Heirs take fractions the Act states. If you cannot point to the Act, you cannot point to the fraction. A nomination on a bank form is often not the same thing as either a will or the intestate scheme. Treat a nomination as its own document until you have read the rule that governs that asset.
How to approach a problem
Ask whether the person has died. Ask whether a will is alleged. Ask which community or which Act the problem names. If it names none, stop at the method. Do not distribute a house in percentages. Do not confuse a lifetime gift, already made, with the estate. Property that was transferred earlier is not in the estate to inherit.
A checklist for succession
Do not invent a fraction. 1. Confirm the death. 2. Ask whether a valid will is in the facts. 3. If not, you are in intestacy. 4. Name the Act or say it is unnamed. 5. Keep lifetime transfers in the property chapter. 6. Do not treat one religion’s share as national. 7. Confirm the Act on India Code.
Kanoons Academy does not currently list a separate LAWCET, CLAT, or AP LAWCET batch in the catalogue; these notes are study material, and counselling is via . The nearest catalogue course is . That course teaches how to read an Act, a rule, and a judgment note. It is not an entrance-test batch, and the button on this page uses the course’s own name.
Frequently asked questions
Does every Indian family follow the same inheritance shares?
No. Succession statutes differ. A fraction from one Act is not the fraction in another. This note prints none of them.
Is a will the same as a gift?
No. A will speaks on death and can usually be revoked while the person is alive. A completed gift passes property sooner, under the transfer rules.
Is a bank nomination a will?
Do not assume it is. A nomination and a will do different jobs. Read the rule for that asset and the succession Act that applies.
Can this page draft a will?
No. A will is a personal legal document. This is a map of the two routes, testate and intestate.
