A deduction that never becomes a credit
The point of TDS compliance is a credit on the right PAN, visible to the payee, supported by a statement and a certificate. Teams that stop at "we deducted something on the bill" have not finished. sets that standard. A review asks, for a sample of vouchers: right category, right rate for this year, right PAN, challan, statement line, certificate. Any break is a finding, even if the vendor has not complained.
Interest, fee, and the disallowance of expense where tax was required to be deducted and was not, are statutory. Amounts and percentages move. This article does not print them. When a finding is late deposit or non-deduction, look up the current consequence on the Income Tax Department portal and compute it there, then book it. Do not negotiate the figure from memory.
Classification and threshold errors
Contractor, professional, rent, commission, and salary are different categories with different thresholds and rates. A designer on a retainer is classified from the contract and the conduct of the work, not from whichever rate is lower this week. Salary mislabelled as a professional fee skips the payroll estimate entirely and lands on the wrong statement. and a 26Q fee are not interchangeable.
Thresholds are applied on the year's aggregate where the provision says so, not on a single bill that happens to sit below a number someone remembers. Splitting invoices to stay under a threshold is a finding, not a plan. Read the aggregation rule for that category on the official page for the year. Lower-deduction permissions are applied only inside their cap and dates; a permission for one contract is not a permission for the vendor's entire ledger.
PAN mistakes are credit mistakes
A transposed digit deposits tax against a stranger or against nobody. Higher-rate deduction for a missing PAN is a prompt to collect the PAN, not a permanent setting. Match name and PAN when the vendor is created, and again when the statement is built. A correction statement can move a credit later. It cannot make the payee's original filing season painless. is where the bad PAN becomes a bad line.
Gross versus net in the books
The expense is generally the gross bill. Tax deducted is a liability until deposited. Booking the net payment as the expense understates the deduction and confuses the return. The payee's income is also gross. If your voucher narrative says "fee net of TDS", the ledger still needs a gross expense and a tax liability. Auditors look for that pair.
Deposit, statement, and certificate lag
Tax deducted and sitting in the company's bank account is not tax deposited. The deposit date is a statutory date for the month, published for the year; copy it from the portal. A statement filed without a deposit, or a deposit never allocated on a statement, fails the payee. Certificates from TRACES come after an accepted statement. Promising Form 16 before Form 24Q is accepted creates a PDF that will not match Part A.
Late fee on the statement and interest on late deposit are separate. Paying one does not cure the other. should be issued from the accepted data, for the right form. A salary case on Form 16A is a classification error that has already reached the employee.
A retainer, a landlord, and a closing-week scramble
A firm pays a monthly retainer to a lawyer, rent to an individual landlord, and year-end bonuses to staff. In March the accountant deducts a single remembered rate on the retainer and the rent, skips the landlord because one month's rent looked small, and deposits salary tax after the date the portal required. In May the quarterly statements are still drafts, so neither the lawyer nor the landlord can see credit, and Form 16 is a spreadsheet the payroll vendor designed.
The review separates three categories, looks up three current rules, aggregates rent for the year, deposits what was short with the statutory interest computed from the official method, and files 24Q and 26Q as different statements. Certificates follow acceptance on TRACES. The spreadsheet Form 16 is destroyed so nobody files from it. That is a quarter recovered. It is also a quarter that needed a calendar.
Checklist for a TDS compliance review
Sample a month and a quarter, then widen if the sample fails. 1. For each voucher, name the category from the contract. 2. Attach this year's threshold and rate from the official page. 3. Verify PAN and name. 4. Confirm a lower-deduction permission before using a lower rate. 5. Match the challan date to the deposit rule for that month. 6. Match statement lines to vouchers and challans. 7. Confirm the statement acknowledgement exists. 8. Confirm certificates were issued from TRACES, not from a local template.
Write findings as category, amount, and the official consequence you looked up, with the URL date. uses this sample method so a review does not become a second, equally informal rate list.
Where this sits in the wider compliance year
TDS is one calendar inside a business that may also have GST, a company return, and payroll law. A startup that hired its first employee has crossed into salary withholding even if the rest of the stack is new. The hiring checklist in should gain a TDS line on that day, not at the first notice.
Owners who are also payees must remember both hats. The company's deduction on their remuneration is the company's compliance and their personal credit. One working paper should not try to be both the 24Q file and the personal return. Split them, then reconcile the credit across.
Frequently asked questions
We deducted tax. Is compliance finished?
Deposit it against the right PAN, report it on the right quarterly statement, and issue the certificate. Deduction without the later steps leaves the payee without credit.
Can I use last year's TDS rate?
Only as a prompt to look up this year. Read the category rate and threshold on https://www.incometax.gov.in/. Finance Acts change them.
One rent payment is small. Can I ignore it?
Check whether the provision aggregates payments to that payee across the year. A single small bill can cross the threshold once the year is totalled.
The challan is paid. Why does the vendor see no credit?
The quarterly statement allocates the challan to a PAN. If it is unfiled or the PAN is wrong, the vendor's tax-credit view stays empty. File or correct the statement.
What is the interest rate for late TDS deposit?
It is statutory and can change. Use the rate and the calculator or provision published on the Income Tax Department portal for that period. This article does not print the rate.
Can I issue Form 16 from our own spreadsheet?
Part A should come from TRACES after the salary statement is accepted. A local spreadsheet will not match the employee's tax-credit statement.
