An annual tax collected in monthly pieces
Salary withholding is not a flat slice of this month's payslip taken in isolation. The employer estimates salary for the whole year, adds other income the employee has asked them to consider, subtracts exemptions and deductions the regime and the declaration support, computes tax for the year, subtracts tax already deducted, and spreads the rest across the remaining months. A bonus, a raise, or a resignation makes the estimate wrong until it is rebuilt. places this inside the wider credit system.
The employee's return later recomputes the same year from certificates and other documents. If the estimate was low, the return shows tax payable. If it was high, the return shows a refund, after processing. Neither result means the payroll team "did TDS wrong" without a comparison. Compare estimate to outcome, then decide.
Declarations, proofs, and the regime
Employees tell employers which regime to apply for withholding, and they submit declarations of investments, rent, and loans that the chosen regime still allows. A declaration without proof, by the date the employer sets so they can honour the year, does not have to be honoured. Employers who deduct on a mere declaration and never see evidence create a refund myth the return cannot keep if the employee also cannot evidence the deduction.
The regime used for payroll can differ from the regime used in the return, within the switching rules for that year. When it differs, Part B of Form 16 and the return will not match line for line, and the credit in Part A still will. Explain the difference in one sentence on the file. is the comparison. are applied to taxable income under whichever regime the estimate uses. This article prints neither the slabs nor any rebate amount.
Perquisites and reimbursements
Not every amount on a cost-to-company sheet is taxable salary, and not every reimbursement is exempt. The valuation of perquisites follows rules for that year: housing, cars, stock options, and concessional loans are the usual arguments. Put the valuation note in the payroll file. A reimbursement policy that the Act does not exempt is salary, however the offer letter described it.
More than one employer
A joiner must be asked for salary and tax deducted by the previous employer in the same year. Without that, the new employer computes tax as if the year started on the joining date, and annual tax is under-withheld. The return still adds both salaries. Collect the previous certificate or a signed previous-salary statement before the first payroll of the new job.
Deposit, statement, and Form 16
Tax deducted from salary is deposited against the employee PAN, reported on the quarterly salary statement, and eventually printed on Form 16. The monthly deduction on the payslip is only the first of those steps. A payslip that shows deduction, with no challan and no statement, is a credit the employee cannot see. Payroll compliance includes the calendar for deposit and for Form 24Q, copied from the official portal for the year.
Part A of Form 16 comes from that statement through TRACES. Part B explains the estimate. Employees should read both, as describes, before they file. Employers should be able to hand Part A because the statement was accepted, not because someone typed a lookalike PDF.
A raise in October and a rent declaration
An employee starts the year on a salary the employer annualises. In October the salary rises. In June the employee declared rent under the old regime and was late with receipts. A correct payroll rebuilds the annual estimate in October, spreads the remaining tax over the remaining months, and, if receipts never arrive by the employer's proof date, drops the rent exemption and rebuilds again. The last months of withholding look heavy. They are the correction, not a penalty rate.
At year end Form 16 shows the revised taxable salary and the total tax deposited. The employee who then files under the new regime recomputes without the rent exemption anyway. The employee who files under the old regime needs the rent evidence in the return file even if the employer already saw it. The payslip is not the evidence of rent. The receipt is.
Checklist for a salary-TDS year
Employers can initial this. 1. Confirm each worker is an employee, not a contractor. 2. Record the regime declaration. 3. Annualise salary, including planned bonus if the policy makes it salary. 4. Apply only exemptions and deductions that regime allows, and only with proof. 5. Ask joiners for previous-employer salary and tax. 6. Recompute when salary changes. 7. Deposit against PAN on the official timetable and file the salary statement. 8. Issue Form 16 from accepted statement data.
Employees initial a shorter list: declaration given, proofs kept, Form 16 matched to the tax-credit statement, return recomputed under the regime they actually want. uses a mid-year raise as the test of whether someone understands the annual estimate.
Interest and fee when payroll is late
Late deposit of salary tax and a late quarterly statement have statutory interest and fee consequences. The rates and the fee cap are year-specific. Read them on https://www.incometax.gov.in/ when a month was missed. Do not negotiate them from a blog figure. The operating fix is a deposit calendar owned by a named person, with a backup signatory, so one leave does not miss a month.
Employees are not the right people to absorb a deductor's lateness by forgoing credit. If the statement is corrected, the credit appears. Until then, the employee's file should show the payslip deduction and the missing statement as an open item with the employer, not as a fabricated credit line.
Frequently asked questions
Is TDS on salary a fixed percentage of the payslip?
It is the remaining annual tax, estimated under a regime, spread over the remaining months. A raise or a new declaration changes it.
Where are the slab rates used for payroll?
On https://www.incometax.gov.in/ for the assessment year and the regime. This article does not print them. They change with the Finance Act.
My Form 16 and my return use different regimes. Is that wrong?
Not always. Payroll follows the declaration to the employer. The return follows the regime the law allows. Recompute and keep both workings.
I joined in November. Will the new employer deduct the full year's tax?
Only if you report previous salary and tax already deducted. Otherwise they estimate from the joining date, and your return adds the earlier months.
Does the employer file my income-tax return?
The employer deducts tax, files the salary statement, and issues Form 16. You file your own return unless a specific arrangement says otherwise, and you still verify it.
Why is March deduction larger than April?
Often a bonus, a proof that was disallowed, or a correction of an estimate that was too low. Ask for the annual computation, not only the month.
