The three people in a TDS story
Every deduction has a payer, a payee, and the government. The payer is the deductor. The payee is the deductee. The deductor withholds tax from a payment the law covers, deposits it against the deductee's permanent account number, and later reports it. The deductee is still taxed on the income. The withheld amount is a credit, not a second tax and not a reduction of the income.
If the PAN is missing or wrong, the credit lands on nobody's return, or on the wrong person. The first control is the PAN on the invoice or the employee master, checked before payment. is the return that eventually uses the credit. This note is the path the credit takes to get there.
Which payments attract deduction
The Act lists categories: salary, interest, rent, contractor payments, professional or technical fees, commission, and others added or narrowed by later Finance Acts. A payment is covered because it fits a category, not because it is large in a vague sense. Thresholds, rates, and exclusions are figures. They change. This guide does not print them. For each payment, name the category in your own words, then read the current provision and the rate chart the Income Tax Department publishes for that year.
Some payers are required to deduct and some payments are excluded because of the payer's status, the payee's status, or a lower-deduction permission the payee obtained. A lower or nil deduction permission is a document with a limit and a period. Pay outside the limit or the period and the ordinary rule returns. File the permission with the voucher. Do not trust a verbal "we have a certificate".
Deduction is not the final tax
The rate of deduction is often a withholding rate, not the slab rate on the deductee's total income. Salary is the exception in spirit: the employer estimates the employee's annual tax and withholds through the year, which explains. For a professional fee, the tax withheld is a credit against whatever the return eventually computes. The deductee may still have tax to pay, or a refund, once other income and deductions are in the picture.
Collection at source is a cousin, not the same form
Tax collected at source is withheld by a seller or another collector in categories the Act lists, and it too becomes a credit. It is reported on its own statement. If a client says "TDS" and the document is a collection entry, label it correctly in the reconciliation. The credit still belongs in the return. The statement type differs, which matters when you reach .
From payment to credit on the return
The order is stable even when dates move. Deduct at payment or credit, whichever the provision uses. Deposit the tax against the PAN. Include the deduction in the quarterly statement for that category. Issue the certificate the law requires. The deductee then sees the credit on the tax-credit statement and in the annual information on the e-filing portal, and claims it in the return. Break any link and the income may still be taxed with no credit attached.
Certificates are how the deductee reads what you deducted. Salary uses one certificate; most other payments use another. Both are explained in . Deductors download certificate data from TRACES at https://www.tdscpc.gov.in/. This note does not describe menus. Use the help on that site for the quarter you are certifying.
A company paying a designer and its landlord
A small company pays a designer a monthly professional fee and pays rent to a landlord who is an individual. Each payment needs its own category. The designer's fee is not salary unless the relationship is employment, with all that employment implies for . The rent is not a professional fee. Look up each category's threshold and rate for this financial year on the official page, apply the one you found, and store the page with the voucher.
The designer claims the credit in their return against professional income, gross of the tax. The landlord claims the credit against rent. The company expenses the gross amount in its own computation and does not treat the withheld tax as its own advance tax. Three returns, three roles. Mixing them is the defect, not a rounding difference.
Checklist before the first deduction of the year
Set the master once, then test every new vendor. 1. Collect PAN and match it to the name. 2. Classify the payment: salary, contractor, profession, rent, interest, or something else. 3. Read this year's threshold and rate on the Income Tax Department page and write both on the voucher. 4. Check for a lower-deduction permission and its limit. 5. Deduct, deposit against that PAN, and diary the deposit date the law states for the month. 6. Plan the quarterly statement. 7. Plan the certificate. 8. Tell the payee the credit belongs in their return, gross of tax.
Rates and deposit dates are copied from https://www.incometax.gov.in/ for the year, not from this article and not from last year's voucher stamp. starts TDS with classification, because a perfect challan on the wrong category is still wrong.
What the deductee should do with the credit
The deductee includes the gross income and the credit. They match the certificate to the tax-credit statement before they file. A missing credit is a conversation with the deductor about the statement, not a silent claim of a number the statement does not show. Filing the return around that credit is .
If you are the deductor, your compliance is deposit, statement, and certificate. If you are the deductee, your compliance is gross income and a credit you can see. The same person can be both, on different payments, in the same month. Keep two checklists.
Frequently asked questions
Is TDS an extra tax on top of income tax?
It is income tax withheld early. The deductee claims it as credit in the return. The income is still reported gross.
Where do I find the rate?
On https://www.incometax.gov.in/ for the payment category and the year. Rates and thresholds change with the Finance Act. This guide does not print them.
What if the payee has no PAN?
The Act usually requires deduction at a higher rate and the credit may not reach a return. Collect and verify PAN before payment.
Does the deductor's expense get reduced by the tax?
The deductor generally books the gross expense. The withheld tax is a liability until it is deposited, not a reduction of the expense.
Where are TDS certificates downloaded?
Deductors download them from TRACES at https://www.tdscpc.gov.in/. Follow that site's own help for the quarter. This article does not describe menus.
I was deducted on a fee. Do I still file a return?
If a return is required for your income, yes. The deduction is a credit inside that return, not a substitute for filing.
