Which ITR Form Should You File?

The utility asks; the facts answer
The e-filing utility does not ask you to memorise a form number. It asks whether you are resident, whether you have business or professional income, whether you have capital gains, how many house properties you have, and whether you hold foreign assets or directorships. Those answers select a form. Your preparation is to answer them from documents, not from the form you used last year.
Eligibility conditions are amended. A monetary ceiling, a bar on certain gains, or a residence test that kept someone out of a simple form can be relaxed or tightened in a later year. This article describes usual fact patterns. It does not state ceilings. Before you commit, open the assessment year's utility on the Income Tax Department portal and read the form it is willing to validate. begins after that screen.
Four patterns practitioners actually see
Salary or pension, one house property, and interest or similar other-source income, with none of the complicating facts below, is the usual pattern for a resident individual. Add capital gains, more than one house, foreign assets or income, or a company directorship, and the file usually moves to , still without a business.
A proprietorship or a profession with books, a partnership share, or speculative or specified business that the presumptive form will not take, is the usual pattern. A resident person who is eligible to declare business or professional income under a presumptive scheme, and who has no disqualifying income, is the usual pattern. "Usual" is a starting hypothesis. The utility confirms it.
Facts that push you off the simplest form
Look specifically for: more than one house property, any capital gain, foreign bank or foreign security or signing authority abroad, being a director of a company, holding unlisted equity, brought-forward losses the simple form cannot carry, agricultural income above the limit the form states, or income of another person that must be clubbed in a way the simple form rejects. Any one of these is a reason to leave ITR-1 and re-answer the utility. The limit amounts live in the form instruction for the year.
Individuals are not the only filers
Hindu undivided families use individual-style forms when their income matches, and they do not use a company form. Firms and companies have their own forms, which this cluster does not treat as ITR-1 through ITR-4. If the permanent account number belongs to a company, stop and select the company form the utility shows. A director's personal return is a separate file from the company's return.
Business income changes the question
The moment there is a business or a profession, ask whether a presumptive scheme is open and whether the person wants to use it. Presumptive schemes substitute a statutory percentage of turnover or gross receipts for a detailed profit computation, inside turnover ceilings and exclusions the Finance Act sets. Those percentages and ceilings change. Read them on the portal for the year; do not type a remembered percentage.
If the person is a partner in a firm, maintains books, has capital gains the presumptive form bars, or has turnover outside the scheme, ITR-3 is the usual destination. GST turnover is not the same figure as income-tax turnover, but a GST registration is a clue that business income exists. Keep the GST facts and the income-tax form decision in the same client folder without copying one number into the other.
A freelancer with a mutual-fund sale
A resident designer invoices three Indian clients, has no staff, and in March redeems a mutual fund. Last year they filed the simplest salary form because they were employed. This year there is no employer, there is professional income, and there is a capital gain. ITR-1 is the wrong hypothesis. Whether ITR-4 still accepts them depends on whether the professional presumptive scheme covers the invoices and whether this year's ITR-4 still allows that mutual-fund gain. If the gain is barred, the utility will push the file to ITR-3 even though the business itself is small.
Write the two questions on the cover: scheme available, and gain permitted inside the presumptive form. Answer both from the form instruction, then prepare either the presumptive schedules or the fuller business and capital-gains schedules. The regime comparison still has to be done on both packages the law offers, and a business file must respect any restriction on switching regime in later years.
Checklist before you select the form
Answer in writing. 1. Who is the person, and are they resident for this previous year? 2. List heads that have documents. 3. Count house properties. 4. Mark any capital gain, including mutual funds. 5. Mark foreign assets, directorships, and unlisted shares. 6. Mark business or profession, and whether a presumptive scheme is being used. 7. Open the utility for this assessment year and read which form it validates. 8. If it disagrees with your hypothesis, believe the utility and change the working paper.
Store a screenshot of the eligibility result with the date. Form rules feel stable until the instruction PDF for the new assessment year says otherwise. makes students defend the form choice in one paragraph before they touch schedules.
After the form is selected
Stay inside that form's schedules. Adding a capital-gains line to a form that has no such schedule means you are in the wrong form, not that you should attach a side letter. Re-select. Then file on that form and keep the acknowledgement against the same form number.
The four guides — ITR-1, ITR-2, ITR-3, and ITR-4 — explain the schedules each pattern usually contains. Read the one the utility selected, plus the neighbour you almost selected, so you can see what would have been missed. The beginner map of income tax in India is the place to reset the year labels if the file has drifted.
Frequently asked questions
Can I use the same form as last year?
Only if this year's facts and this year's utility still allow it. A new gain, a new business, or a new instruction is enough to change the form.
I have only salary. Is ITR-1 automatic?
Salary-only is the usual ITR-1 pattern for a resident individual, subject to house-property count, residence, foreign assets, directorship, and the income ceiling the form states this year. Confirm on the utility.
Where do capital gains go?
Usually ITR-2 when there is no business, and ITR-3 when there is business the presumptive form will not combine with those gains. Check this year's bar on the presumptive form.
What is the presumptive percentage I should type?
The percentage and the turnover ceiling are in the Finance Act and the form utility for the assessment year. This article does not print them. Read the official instruction.
Do companies use ITR-3?
ITR-3 is for individuals and Hindu undivided families with business or professional income. Companies use the company form the utility offers.
The utility and this article disagree. Which wins?
The utility for the assessment year. Treat this article as a way to prepare the facts, then follow the form the portal will validate.
