A writ is a named constitutional remedy
Writ jurisdiction is not a synonym for every lawsuit. It is the power, stated in the Constitution, to issue certain orders. are the Part III cluster Article 32 is associated with. High Courts are studied through Article 226, which students also meet in the context of other legal rights. The wider idea of courts examining public power is . The method for the Articles themselves is . Confirm both Articles on India Code. A coaching chart is not the Constitution.
Five names, and what each name is for
Habeas corpus is the textbook name for a challenge to unlawful detention. Mandamus is the name for an order directing a public authority to perform a public duty. Prohibition and certiorari are the names used when a court is asked to keep a lower authority inside its power, one before a decision is completed and one after, in the way your course distinguishes them. Quo warranto asks by what authority a person holds a public office. These are labels. The conditions sit in the Articles, the rules of the court, and the cases. Do not file a writ because a label sounded close.
What an answer must not become
Do not write a petition. Do not name a bench, a diary number, or a paragraph you have not seen. Do not promise that a High Court will hear a private employment quarrel as a writ. Whether a respondent is the State, or a body performing a public duty, is a legal question you argue from Article 12 and from the cases you open. If you have not opened them, say the point is unchecked. Public law and a private contract can appear in one story. They are still different claims.
A hypothetical about the wrong form
Hypothetical. A tenant wants the landlord to repaint a flat and heads the page “writ of mandamus.” No public duty is described. The rewrite says mandamus is aimed at a public duty, this problem looks like a private lease, and the writ heading is the wrong form. The student is told to read Article 226 before using it, and not to send the page to a court. The paint dispute stays a property or contract problem until the facts show a public authority.
A checklist before you use a writ’s name
Use the name only as a study label. 1. Say which court the problem is asking about. 2. Open Article 32 or Article 226, whichever the problem names. 3. Match the facts to one writ’s job, or say that more than one might be argued. 4. Ask whether the respondent is a public authority. 5. Do not draft prayers. 6. Do not invent a holding. 7. Confirm the Articles on India Code.
Kanoons Academy does not currently list a separate LAWCET, CLAT, or AP LAWCET batch in the catalogue; these notes are study material, and counselling is via . The nearest catalogue course is . That course teaches how to read an Act, a rule, and a judgment note. It is not an entrance-test batch, and the button on this page uses the course’s own name.
Frequently asked questions
Are Article 32 and Article 226 the same?

What is mandamus?
It is the textbook name for an order compelling performance of a public duty. It is not a tool for every private complaint.
Can this note be filed in court?
No. It is a classroom map of names. A writ petition is a court document. Sending one has consequences this page will not script.
Will you list leading writ cases?
No. A case note needs the judgment. This page gives the constitutional names and tells you to open the Articles and the report your course assigns.
